What YouTube and the FTC require

YouTube's paid product placement policy requires creators to tick the "includes paid promotion" box in video settings when a video contains paid product placements, endorsements or sponsorships. YouTube then shows a disclosure label to viewers.

The FTC's "Disclosures 101 for Social Media Influencers" says that in a video the disclosure should be in the video itself, not only in the description, and that saying it out loud as well as showing it on screen is best. Viewers may never expand the description.

Frequently asked questions

Does a fair use disclaimer protect my YouTube video from copyright strikes?

No. Content ID and copyright strikes are handled by YouTube's own systems, and whether your use is fair depends on the four factors in Section 107, not on the statement. The disclaimer shows good faith; real protection comes from using only what you need, transforming it, and adding your own commentary.

Where should I put the disclaimer on YouTube?

Put the most important one (sponsorship or affiliate) in the video itself and in the first lines of the description, above the "more" cut. Keep a full disclaimer on your website or channel About page and link to it.

Is it really free? Do I need an account?
